Mediation often offers a faster and more cost effective means of resolving disputes when compared with the options of litigation and arbitration.
Not all disputes are able to be resolved by mediation, but the fact that the Courts often encourage mediation as a first step to resolving disputes, and have even been known to award costs against successful litigants who had refused to mediate, is possibly an indication of just how successful they consider that the procedure can be.
